These Terms of Service ("TOS") outline the rules and regulations for using our website(s) (referred to as "Site" or "Sites") and related services. By accessing or using our Site, you agree to comply with these TOS. Please read them carefully before placing any orders on baltzar.com.

1. General

Engelska Herrekiperingen AB, trading as Baltzar, with a registered office at Mejselgatan 3, Malmö 21120, Sweden, operates the Baltzar website and services. For any inquiries, you can contact our customer service at contact@baltzar.com.

2. Orders

To place an order, you must add the desired items to your Shopping Bag, provide your billing and shipping address, select the preferred delivery option, and choose your payment method. Please note that adding items to your Shopping Bag does not guarantee their reservation, as they may be purchased by other customers.

3. Pricing Policy

The prices displayed on our Site are specific to the country/region you are shipping to and are inclusive of VAT at the applicable rate for orders within the European Union (EU), United Kingdom (UK), and Norway. For customers from other countries, prices will be shown without VAT. It's important to note that prices are subject to change due to currency exchange rate fluctuations, markdowns, and other commercial factors. The price applicable to your order will be the one in effect at the time of acceptance.

For customers in DDP (Delivery Duty Paid) countries (EU, UK, NO), no additional import duties or taxes will be charged. However, for customers outside the DDP countries, import duties, customs fees, and local taxes may apply upon arrival of the order in your country, and you will be responsible for these charges.

4. Acceptance of Your Order

After placing an order, you will receive an email confirming the details of your order. This email serves as an acknowledgement of your order and does not constitute acceptance. The acceptance of your order and the formation of a contract between you and Baltzar occur when we email you to confirm that the goods have been dispatched. The contract will be concluded in the English language. Our third-party payment processor and courier do not have the authority to accept orders on behalf of Baltzar.

We reserve the right to refuse or cancel an order for various reasons, such as payment authorization issues, shipping restrictions, unavailability of items, failure to meet eligibility criteria or violation of the TOS. In such cases, we will not be liable for refusing or cancelling the order after processing has begun.

5. Payment

Payment can be made using Visa, MasterCard, American Express, and other methods advertised on the Site. PayPal is also available as a payment option. Payment will be debited from your account upon dispatch of your order. By using a credit/debit card, you confirm that you are the authorized cardholder or have explicit permission from the card owner. All cardholders are subject to validation checks and authorization by the card issuer.

We strive to ensure the security of our Site. Credit/debit card transactions are processed using a secure online payment gateway that encrypts your card details.

6. Intellectual Property Rights

The Site and its contents, including all copyrighted materials, trademarks, and other intellectual property rights, belong to Baltzar. You are granted a limited, non-exclusive, and non-transferable right to use the Site and its content for personal, non-commercial purposes. Reproduction, distribution, or any unauthorized use of the content is strictly prohibited and may result in legal consequences.

7. Content

In addition to the intellectual property rights mentioned above, "Content" refers to graphics, photographs (including image rights), sounds, music, videos, audio, or text present on the Site. While we strive to provide accurate and complete information, Baltzar does not guarantee the accuracy or error-free nature of the Content. We cannot guarantee that the Site, Baltzar's Content, or the server hosting it are free from viruses or other harmful components. We recommend ensuring you have up-to-date virus-checking software installed.

The personal opinions expressed by designers, labels, or any third parties associated with Baltzar are their own and do not necessarily reflect the views of Baltzar. We assume no responsibility for any views expressed in any media.

8. No Commercial Use

The Site is intended for personal, non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, data mine, or sell any Content, software, products, or services within the Site. Any commercial use, including advertising or revenue generation activities on your site, using this Site or its Content, is strictly prohibited.

9. Your Activity

You are personally responsible for your use of the Site and your communication and activity on it. We reserve the right to deny you access to the Site temporarily or permanently if we determine that you have engaged in prohibited activities, violated the TOS, or shown disrespect towards other users.

10. Third-Party Links

The Site may include hyperlinks to websites or resources operated by parties other than Baltzar, including advertisers. We have not reviewed all the linked sites and do not endorse or assume responsibility for the content, accuracy, availability, or privacy practices of these external websites or resources. Your access and use of such linked sites are at your own risk, and you should review their respective terms and privacy policies.

11. Force Majeure

Baltzar will not be responsible for any failure to fulfil its obligations under the TOS if such failure arises from events beyond its reasonable control.

12. Compensation

At our request, you agree to defend, compensate, and hold Baltzar and its officers, directors, agents, affiliates, licensors, and suppliers harmless from any liabilities, claims, expenses, damages, and losses (including legal fees) arising from any breach of the TOS by you or any other person accessing the Site using your internet account, caused by your actions or inactions.

13. Our Relationship

No joint venture, partnership, employment, or agency relationship exists between you and Baltzar as a result of the TOS or your use of the Site. You agree not to hold yourself out as a representative, agent, or employee of Baltzar, and we shall not be liable for any representation, act, or omission on your part.

14. No Waiver

If Baltzar does not take action against any breach of the TOS by you, it does not waive its rights and remedies in any other situation where you breach the TOS.

15. Governing Law and Dispute Resolution

The TOS is governed by Swedish law, without prejudice to any mandatory consumer protection provisions. Any dispute arising out of or in connection with the TOS shall be subject to the exclusive jurisdiction of the Swedish courts.

Please note that these Terms of Service are subject to change, and we recommend reviewing them periodically. If any changes are made, we will notify you by posting the revised TOS on the Site. The revised terms will be effective immediately upon posting.
